Terms of service

These terms apply when you use the Kauri Auto Parts website or buy from it. The store is operated by Orry Campbell Coburn, sole trader, trading as Kauri Auto Parts (NZBN 9429053778222), a registered New Zealand business — "we" and "us" below. Placing an order means you accept these terms.

What we sell

We sell replacement parts for passenger vehicles to customers in New Zealand. Unless otherwise stated, products are aftermarket replacement parts. They are not manufactured, sponsored, or endorsed by the original vehicle manufacturer. Where a manufacturer or model name appears in a listing, it is there to identify what the part fits, and nothing more.

Who can order

By ordering from this website you confirm that you are at least 18 years old, or that you have the consent of a parent or guardian, and that you are legally able to enter into a binding agreement.

Prices and payment

Prices are in New Zealand dollars and include GST (15%). The price shown is the total you pay: delivery is free, and no customs, duty or import charges apply to orders delivered within New Zealand. Payment is due in full at the time of purchase, and is processed securely by Shopify. The methods available to you are shown at checkout. We do not see or store your payment card details.

We may change prices at any time, but a change never affects an order already placed. If a part appears at an obviously incorrect price through a technical or human error, we will contact you before processing the order rather than simply charging you.

Orders

Your order is an offer to buy. An order confirmation email is an acknowledgement that we have received your order — it is not our acceptance of it. A contract is formed only when we send the part. Up until that point we may decline the order — for example where a part is no longer available from our supply partners, where a listing carried an error, or where we cannot verify the delivery details. If we decline an order you have already paid for, you receive a full refund.

Making sure a part fits

Vehicle compatibility varies by make, model, year, production date and specification, and the same model can leave the factory with different parts. Confirming that a part suits your vehicle before ordering is your responsibility — but you do not have to do it alone. Send us your registration, or your make, model and year, and we will confirm the fit before you pay. That service is free, and it is considerably quicker than a return.

Product information

We work to keep part references, descriptions, images and compatibility notes accurate. Images are indicative, and a part may differ in finish or branding from the photograph shown. Minor variations of that kind are not grounds for a return unless the part is materially different from how it was described. If something in a listing looks wrong to you, tell us and we will check it.

Delivery

Delivery is free within New Zealand, and orders typically arrive within 3 to 10 working days of being placed. Full details, including what happens if a parcel goes astray, are in our shipping policy. Risk in a part passes to you when it is delivered.

Returns

If a part is faulty, arrived damaged, or is not the part you ordered, tell us — your rights in that situation come from the Consumer Guarantees Act 1993 and are not limited to a set number of days. If you changed your mind, you have 30 days and the part must be unused and unfitted. Our refund policy sets out the conditions and how to go about it. Your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 are not affected by it.

Your rights, and the limits of ours

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. Any part of these terms that would have that effect does not apply. Nothing in these terms limits our liability for death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded.

Where you buy parts for the purposes of a business, the Consumer Guarantees Act does not apply, and our total liability in connection with an order is limited to the amount you paid for it.

Otherwise, and to the extent the law allows, our responsibility for any claim relating to a part or to this website is limited to replacing the part or refunding what you paid for it. We are not liable for indirect or consequential loss — lost income, vehicle hire, or workshop labour booked in advance, for example. Parts must be fitted by someone competent to fit them, and we cannot be responsible for damage caused by incorrect fitting or removal.

If something goes wrong between us

If you have a problem with an order or with us, please contact us first — email info@kauriautoparts.co.nz or phone 027 596 5051. Almost everything is quicker to fix directly, and we would rather sort it out than have you take it further.

Changes and governing law

We may update these terms from time to time; the version published when you order is the version that applies to that order. These terms are governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction over any dispute arising from them.
